EIN for newly incorporated foreign=owned corporations?

Hi all,

If a foreign company wants to set up foot in the US and incorporates a C-Corp (for instance, in Delaware) without (yet) a management team in the US, how can it get an EIN from the IRS?

It used to be that the incorporator (CPA, lawyer...) could enter its own SSN as the EIN requester but now the IRS apparently mandates that the person providing its SSN have an actual role in the company or call the IRS by phone to get the EIN without the SSN requirement.

Has anyone here gone through this process and has valuable feedback? Is it overly complex and long?

Note my question pertains to the EIN-by-phone process, not the online process (which I'm already pretty familiar with).

I just did this last week. I incorporated using clerky.com (highly recommend it!) and then called the IRS up. I was on hold for an hour, but when I got through, it was quick and painless. I gave them my info and they gave me an EIN.

Did they ask that you send them any piece of evidence (such asthe certificate of registration)that shows you're the company owner or have power-of-attorney to request such an EIN?

No problem. They did not request any supporting documents. And (267) 941-1000 (Philadelphia) is the number to call, 6am to 11pm EST.

Interesting to know that they don't request any supporting document or evidence, while they require a valid SSN on their online form...
