T&C's for an image-based discovery site?

Motoroso will be enabling users (from Joe-schmoe to brands) to upload images, and add engaging elements to that image. Does anyone have thoughts on whether we need to have a full set of legal T&C's written up for our site, or can we steal/modify from somewhere else, or is something like this so turnkey that we can snag it from somewhere like Legalzoom?

I am not a lawyer and therefore cannot give you legal advice. As far as TOS, yes I highly recommend from a business perspective to cover your company by writing and enforcing one. As far as plagiarizing one, I cannot formally recommend that but hey, there are lots out there.

Try EULA too as a search term.

Hi Alex,
I had the same question and currently I used one of this TOS generators :

It has a simple couple questions and it will generate an initial document in a format you can use on your web page

Alex - which path did you choose?

Shachar - which service did you use? Would you recommend?

(looking for an automated solution to creating T&Cs)

Custom Terms of Service / TOCs do not need to cost that much when you are working directly with a solo attorney vs a big law firm. At upcounselwe typically see them go for somewhere in the $500-750 range by an experienced startup attorney.

Disclaimer: Given shameless plugs happen everywhere in these discussion boards without moderation by FD (in spite of messages from me and other members that self-promotion be limited on this site), I'll jump in here.

Contact ZentLaw. The firm that invented the Alternative Law Firm model, On-Demand Legal Counsel offering and Outside GC offerings for startups and established companies. ZentLaw represents every major tech company out there and has done the TOS drill for startup clients thousands of times over. You will not find a better solution at a better cost. Any solo you hire is going to do what you do- find TOS online, modify and then charge you for that. At ZentLaw, we develop Terms and best practices for the largest brands in the world and the top startups who must avoid the risk of claims and class actions.

Custom terms are always advised. Contracts are only useful if relevant and properly constructed. Anything short of that is a waste of both time and money. Good luck.
